1. INVENTORY
A contradictory inventory and an inventory of furniture will be drawn up at the tenant's entrance and will be the subject of a check at the end of stay. If the inventory is not contradictorily established and signed simultaneously by the lessor (or his agent) and the lessee, the inventory made will be questionable by the tenant within 48 hours of the delivery of the rental inventory. In the absence of a dispute by the latter within this 48-hour period, the inventory carried out by the lessor and communicated to the lessee upon entering the accommodation will be deemed to be accepted without reservation by the lessee. An inventory will be drawn up by the lessor (or his agent) and the tenant at the end of the rental. Each retaining a signed copy. Otherwise, the absence of dispute by the lessor within 48 hours following the end of the rental will be worth restitution of the premises in good condition and / or full inventory. The return of the keys to the lessor, at the end of the rental, can in no way constitute a waiver of rental repairs if it is proven that these are due to the Tenant. In accordance with article 1731 of the Civil Code; If at the time of reception of the accommodation by the tenant the inventory has not been made, the accommodation is deemed to have been delivered in good condition by the lessor. This presumption has an important consequence for the tenant: if the exit inventory reveals damage, the tenant must repair them. Otherwise, the lessor can withhold from the deposit the amount intended to pay for rental repairs. However, the following are excluded from work to be paid by the tenant: (i) Damage due to normal wear and tear of the accommodation, (ii) Damage which is not attributable to the tenant - fault of the lessor or force majeure.
2. GENERAL CONDITIONS
☐ Smoking is not allowed inside the apartment.
☐ Respect for the accommodation capacity of the home;
☐ Respect for the destination of the dwelling. No modification, arrangement of furniture and premises is authorized;
☐ Any substitution, under lease of the property in whole or in part, is prohibited, except with the written consent of the lessor;
☐ Formal prohibition of any trade, professional or industrial trade ; the premises covered by this contract are rented as a temporary residence and pleasure craft; Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household. ☐ Subscription by the tenant of insurance against rental risks, theft, fire, water damage, etc.
☐ Respect for places and collective rules and instructions in the building, co-ownership regulations and / or internal regulations of the building (garbage rules, no obstruction of pipes, respect for the neighborhood, cleanliness, etc.); ☐ Reporting of any complaints concerning the facilities within 48 hours of entering the accommodation; ☐ Notify the lessor as soon as possible of any damage affecting the property, its furniture or its equipment and authorize the Lessor, or any third party appointed by him for this purpose, to carry out, during the rental period, any emergency ordered repair. Repairs made necessary by negligence or poor maintenance during the rental, will be the responsibility of the tenant. No deduction or reduction of the rental amount will be granted in the event of urgent repairs; ☐ Acceptance of any possible visit to the premises by the lessor or his agent during the stay;
☐ Waiver of any recourse against the lessor in the event of theft and depredation in the leased premises;
☐ Maintenance and return of the rented accommodation in a good state of cleanliness. Any damaged object must be reimbursed at its fair value to the Lessor. ☐ Pets are allowed the property upon request on acceptance by the lessor
3. QUIET ENJOYMENT
The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hour starts at ____ where outdoor noise should be kept to a minimum.
4. ESSENTIALS
Landlord shall provide the following to the Tenant: _see list by apartment [e.g. towels, linens, cups, knives, forks, spoons, dishes, etc.] 5. LESSOR’S LIABILITY The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.
5. ILLEGAL USE
Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, etc. shall cause termination
6. GOVERNING LAW
This agreement and its consequences are subject to French law. For the execution of these presents, the parties elect domicile at the address mentioned at the beginning of these presents and agree that the competent court will be that of the territory in which the leased premises are located.
